Terms of Service

Effective 7 November 2026

Draft — highlighted details are still to be filled in and the text reviewed by a lawyer before launch.

These terms are an agreement between you (the shop owner) and [[Registered business name, e.g. Pocketshelf Technologies Pvt Ltd]] (“pocketshelf”, “we”), [[Registered office address]]. By creating a shop you accept them.

  1. 1. Who can use it

You must be 18 or older and run a business in India. You are responsible for everything done from your account, including by staff you share it with.

  2. 2. What we provide

Software to build your own store page, list products, run a WhatsApp bot, send offers to customers who opted in and manage orders from a dashboard. You run your shop yourself. WhatsApp messages travel through Meta's WhatsApp Business Platform, so Meta's WhatsApp Business terms, Business Messaging Policy and Commerce Policy also apply to you. Meta may limit or block a number under its own rules; we can't override that. We are not affiliated with Meta.

  3. 3. Plans, trial and billing

    • New shops get a 7-day free trial with Pro features and no card. After it, you need a paid plan to keep your store taking orders.
    • Plan prices, billing periods and limits are shown on the pricing page. Fees are paid in advance; GST is added where it applies. We never charge you automatically: each period is paid by you.
    • If your plan has fewer products or features than you are using, products already listed stay, but you can't add more until you are within the limit or upgrade, and features outside the plan are locked.
    • When a trial or paid period ends and is not renewed, we remind you and give 3 days. After that the WhatsApp bot and your store page stop taking orders until you renew. Your data is kept so you can continue after paying.
    • We announce price changes at least 30 days before they apply to your next billing period.
    • WhatsApp message fees (for example marketing messages) are charged by Meta, not by us.
    • We take no commission on your sales; customers pay you directly.
    • Refunds of plan fees follow our Refund policy.
  4. 4. What you may sell and send

    • Follow Meta's WhatsApp Business Messaging Policy and Commerce Policy at all times.
    • Only items allowed by WhatsApp's Commerce Policy and Indian law. No alcohol, tobacco, drugs, weapons, fireworks/explosives, animals or other prohibited items.
    • Send offers only to customers who agreed to receive them, and stop when they reply STOP.
    • No spam, misleading prices, fake reviews or content you have no right to use.
  5. 5. Your shop, your sales

You are the seller. You set prices, collect GST where applicable, deliver orders, issue refunds to your customers and answer their complaints. Invoices generated by the app use the business details you enter; you are responsible for them being correct.

  6. 6. Your content

Product photos, descriptions, logos and messages stay yours. You give us permission to store and show them only to run your shop (on WhatsApp, your shop page and the dashboard). You confirm you own them or have the right to use them. We remove content when the rights holder shows us it infringes.

  7. 7. Your customers' data

For your customers' personal data you are the data fiduciary and we process it only to run your shop, as set out in our Privacy policy.

  8. 8. Our software and name

The app, its design and the pocketshelf name belong to us. You may not copy, resell or reverse-engineer it. “WhatsApp” is a trademark of Meta Platforms, Inc.

  9. 9. Suspension and closing

We may pause a shop that breaks these terms, Meta's policies or the law, or that puts other shops' numbers at risk — usually after a warning, immediately when it is serious. You can close your account any time by writing to us. You may ask for an export of your products, orders and customers within 30 days; after that we delete your data as described in the Privacy policy.

  10. 10. Liability

The service is provided as it is. We are not liable for lost sales, WhatsApp outages, number restrictions applied by Meta, or payments between you and your customers. Our total liability is limited to the plan fees you paid us in the 12 months before the claim.

  11. 11. Indemnity

If someone makes a claim against us because of what you sold, the messages you sent, the content you uploaded or your breaking these terms or the law, you will cover the reasonable costs of that claim.

  12. 12. Things outside our control

We are not responsible for delays or failures caused by events we can't reasonably control — for example outages at Meta, internet or power failures, natural disasters or government orders.

  13. 13. Changes and law

We will tell you by email or in the dashboard at least 15 days before material changes, and update the date at the top of this page. Using the service after that means you accept the change. These terms follow the laws of India; courts in [[City for courts, e.g. Chennai]] have jurisdiction. Questions: support@pocketshelf.in.
